I sold a Nintendo DS on ebay and the buyer didn't pay for it straight away. It was my first time selling, so I sent the item (which has now been delivered) without the payment from him. I've tried contacting him many times, telling him to pay but he's been avoiding that, he said he'll pay soon. I can open a case tomorrow, but if he still doesnt pay then, what shall i do?!

Oh no, never ever do that!!! He doesn't even have to pay now. Always wait for them to pay. I always give 3 days to pay, then I re-list and file a non payment dispute. But since you went ahead and shipped I hate to say it, but........
You just lost out big time.
Seller on Ebay since 2004. And I have seen all kinds of scams. Be careful and please read the rules and tips on Ebay.
No Payment Ebay
First try to close the issue on mutual understanding, if the buyer try to avoid you again file a new non payment dispute.
Avoid sending items without getting payment next time unless your buyer is reputable one.
Ebay might not do much here that will benefit you. I would suggest you chat with ebay Representative, let them have the item number and buyers ID and see what they can tell you. why i say chat first is because you don't want the buyer to know you are reporting him and decide not to pay anymore.

In the future, use the Paypal option to print the shipping label. It won't let you print one unless the buyer has paid.
File a "non-paying bidder" claim, but once you do that the buyer will just keep the item and not pay you. Ebay may close his account, or they may give credit your account. It's their decision. Good luck.
Wise after the event I think, all you can do is open a case with e-bay and see what happens. Next time no payment no item. Good luck x
What would possess you to send an item before you had payment?
You probably cannot do much. You already sent the item.
I have no idea how your case will turn out simply because it is assumed sellers will have the common sense to wait for payment before sending the goods
You shouldn't have sent the item without the payment first!! I don't think you will be able to recover your losses!
