A little bit of all three, but it was only supposed to be the first two.
We've got too much of a judicial oligarchy involved in our democratic republic: Bush v. Gore, Roe v. Wade, Lawrence v. Texas, and all of those federal judges who have legalized SSM this year.
Judge Learned Hand, giving a speech at a law school in 1958: "Each one of us must, in the end, choose for himself how far he would like to leave our collective fate to the wayward hands of vagarious assemblies. No one can fail to recognize the dangers to which the last 40 years have exposed to such governments. ... For myself, it would be most irksome to be ruled by a bevy of Platonic Guardians, even if I knew how to choose them, which I assuredly do not. If they were in charge I would surely miss the stimulus that comes from participating in a system in which I have, at least theoretically some part in the direction of public affairs. Of course I know how illusory would be the belief that my one vote changes anything, but nevertheless, when I go to the polls, I have a satisfaction in the sense that we are all engaged in a common venture."
The SCOTUS all too often behaves like a bevy of Platonic Guardians, and they've stolen from me the "satisfaction ... that we are engaged in a common venture."
It's becoming all too obvious that under the leadership or should I say lack of leadership of 0bama our Country is fast becoming a member of the third world as a result of 0bama's oligarchy!

It was set up to be a republic. People think it is a democracy. It practices oligarchy.
