In June and July 2009 I purchased 2 HP PC computers that sadly came with Windows Vista Home Premium. I am just now finding out that said computers were eligible for a free upgrade to Windows 7. Obviously I would have wanted Windows 7 had I known about the free upgrade, but now HP is telling me it's too late to upgrade for free. Who's fault is it for not making me aware of the free upgrade to Windows 7? HP says it's my fault for not watching the advertisements on TV and I say it's HP's fault for not sending me an e-mail or at least something to let me know about the valuable upgrade. I don't even watch TV (I am a Med student and don't have time). What should I do? Do I have any legal ground to stand on?

Actually, the person most at fault is the salesperson (who obviously knows of the upgrade) that failed to mention it to you. I bought an HP PC earlier this year and my salesman was very good. I'd bring it to the store's attention, maybe speak with a manager and see if Best Buy or wherever you got it, will do the upgrade sans costs.
HP has contracted with a third party company to fulfill the Windows® 7 Upgrade Option Program from HP. Orders will be accepted June 26, 2009 until February 15, 2010.
It is too late. You have no legal ground to stand on.
I got the Windows 7 upgrade after the deadline (3 months after), but I had to fight for it. I also don't have time for TV and I don't exactly keep in contact with HP in my spare time to stay in the know. I doubt you have a legal claim, but you should try to get them to pay for it. If they don't, just don't buy a HP product again. That's what I would have done. Such a shady company.
The upgrade was voluntary. They didn't have to offer it, you didn't have to accept it. They offered it for a limited time and people who paid attention got it. They weren't obligated to do it in the first place so they can't be obligated to go back and upgrade you for free.
The fact that you're a Med student, even though you're clearly very proud about it, is completely irrelevant.
